This Product Disclaimer (“Disclaimer”) applies to all skincare and personal care products offered by Sunny Day Creations, Inc., a Delaware corporation doing business as Lazyface (“Company,” “we,” “us,” or “our”), through our website at www.lazyface.com (the “Site”). By purchasing or using any of our products, you acknowledge that you have read, understood, and agree to this Disclaimer.

Section 1. Not Medical Advice

Our products are cosmetic products intended for external use on the skin. They are not intended to diagnose, treat, cure, or prevent any disease or medical condition. The information provided on the Site, including product descriptions, ingredient lists, and usage instructions, is for informational purposes only and does not constitute medical advice. If you have a medical condition, skin disorder, or health concern, consult a qualified healthcare professional before using any of our products.

Section 2. Cosmetic Regulatory Status

Our products are cosmetics as defined by the Federal Food, Drug, and Cosmetic Act (21 U.S.C. § 321 et seq.), as amended by the Modernization of Cosmetics Regulation Act of 2022 (“MoCRA”). Cosmetic products are not subject to pre-market approval by the U.S. Food and Drug Administration (“FDA”). The claims made about our products have not been evaluated by the FDA. Our product safety is substantiated by competent and reliable evidence, including ingredient safety data, stability testing, and relevant scientific literature, in accordance with applicable regulatory standards.

Section 3. Allergens, Sensitivities, and Patch Testing

Individual skin types and sensitivities vary. Before using any new skincare product for the first time, we strongly recommend performing a patch test by applying a small amount of the product to a discreet area of skin (such as the inside of your wrist or behind your ear) and waiting twenty-four (24) to forty-eight (48) hours to check for any adverse reaction. Patch testing is particularly important if you have sensitive skin or if the product contains active ingredients such as alpha-hydroxy acids (AHAs), beta-hydroxy acids (BHAs), retinoids, or added fragrances.

If you experience redness, itching, burning, swelling, or any other adverse reaction, discontinue use immediately and consult a healthcare professional. Individuals with known allergies or dermatological conditions such as eczema, psoriasis, or rosacea are advised to review the full ingredient list and consult a dermatologist before use.

Section 4. Safe Use Instructions

Please observe the following general safety guidelines when using our products:

(a) Avoid direct contact with eyes. If product comes into contact with eyes, rinse thoroughly with clean water. If irritation persists, seek medical attention.
(b) Do not apply to broken, irritated, or sunburned skin unless the product is specifically formulated for that purpose.
(c) Keep products out of reach of children. Our products are formulated for adult use and are not intended for use on children under the age of twelve (12) without the supervision of a healthcare professional.
(d) Store products in a cool, dry place away from direct sunlight. Avoid exposure to temperatures above 90°F (32°C) or below 32°F (0°C), which may compromise product integrity.
(e) Check the product’s expiration date or Period After Opening (PAO) symbol before use. Do not use products past their expiration date or beyond the indicated PAO period.

Section 5. Results and Testimonials

Individual results may vary. Any testimonials, reviews, or before-and-after images displayed on the Site reflect the personal experiences of individual users and are not guaranteed outcomes. We do not claim that you will achieve the same results. Product efficacy depends on factors including skin type, frequency of use, environmental conditions, and overall skincare routine. In accordance with the FTC Endorsement Guides, any endorsements or testimonials from individuals who have received free products, compensation, or other consideration will include a clear and conspicuous disclosure of that relationship.

Section 6. Adverse Event Reporting

In accordance with the Modernization of Cosmetics Regulation Act of 2022 (MoCRA), we maintain records of all adverse events associated with the use of our products for a period of six (6) years. A “serious adverse event” is defined as a health-related event associated with the use of a cosmetic product that results in death, a life-threatening experience, inpatient hospitalization, persistent or significant disability or incapacity, a congenital anomaly or birth defect, an infection, significant disfigurement (including serious or persistent rashes, second- or third-degree burns, significant hair loss, or persistent or significant alteration of appearance), or an event that requires medical intervention to prevent one of these outcomes.

If you experience a serious adverse event associated with the use of any of our products, please report it to us immediately at hello@lazyface.com. We are required to submit a report to the FDA within fifteen (15) business days of becoming aware of a serious adverse event. You may also report directly to the FDA using MedWatch Form 3500A, submitted to CosmeticAERS@fda.hhs.gov or by mail to FDA CDER Mail Center, White Oak Campus, Building 22, G0207, 10903 New Hampshire Avenue, Silver Spring, MD 20993.

Section 7. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, SUNNY DAY CREATIONS, INC. SHALL NOT BE LIABLE FOR ANY DAMAGES ARISING FROM THE USE OR INABILITY TO USE OUR PRODUCTS, INCLUDING BUT NOT LIMITED TO ALLERGIC REACTIONS, SKIN IRRITATION, OR OTHER ADVERSE EFFECTS, EXCEPT WHERE SUCH LIABILITY CANNOT BE EXCLUDED UNDER APPLICABLE LAW. YOUR USE OF OUR PRODUCTS IS AT YOUR OWN RISK. THIS DISCLAIMER DOES NOT AFFECT YOUR STATUTORY RIGHTS AS A CONSUMER.
